Terms of service

These terms of service govern the use of the FixPoint platform for reporting and resolving facility maintenance faults. They set out the rules for the free trial, subscriptions, payments and the rights and obligations of both the provider and the user.

1. General

These terms of service apply to the FixPoint service, provided by [legal name, address, registration/VAT number] (the "provider"). By registering, starting a free trial or otherwise using the service, the user accepts these terms in full.

2. Service description

FixPoint is an AI-driven platform for reporting and resolving facility maintenance faults. Faults can be reported by a phone call (AI assistant) or a web form; the system routes each request to the right subcontractor and escalates automatically until the fault is resolved. The provider may develop, change or discontinue individual features over time.

3. Trial and subscription

New users may use a free trial lasting [14] days, which includes [5] test AI calls and requires no payment card. After the trial the service continues only with an active paid subscription in the chosen plan (Basic, Advanced or Enterprise), renewing for successive [monthly] periods until cancelled.

4. Prices and payments

Current prices are published on the pricing page and start at €49 per month for the Basic plan. Subscription fees are charged in advance for each billing period; AI usage beyond the included allowance is billed according to the price list in force at the time of use. All amounts are stated in euros (EUR) and [exclude / include] VAT.

5. User obligations

The user undertakes to use the service lawfully, to provide accurate information and to keep account credentials secure. The user is responsible for all activity carried out under their account and may not misuse the service in a way that harms the provider, other users or third parties, including subcontractors contacted through the platform.

6. Service availability

The provider aims to keep the service available continuously but does not guarantee uninterrupted operation. Access may be limited during planned maintenance or due to circumstances beyond the provider's control. Any specific availability commitments are set out in a separate [service level agreement, where applicable].

7. Limitation of liability

The service is provided "as is". To the maximum extent permitted by law, the provider is not liable for indirect or consequential damage, lost profit or data, or for the acts or omissions of subcontractors engaged through the platform. Where liability cannot be excluded, it is limited to [the amount paid for the service in the preceding 12 months].

8. Termination

The user may cancel the subscription at any time with effect from the end of the current billing period. The provider may suspend or terminate access in the event of a material breach of these terms or non-payment, having given reasonable notice where required by law.

9. Changes to the terms

The provider may amend these terms, for example to reflect new features or legal requirements. Users will be notified of material changes at least [30] days in advance, and continued use of the service after the changes take effect constitutes acceptance of the amended terms.

10. Governing law

These terms are governed by the law of [the Republic of Slovenia]. Any disputes that cannot be resolved amicably fall under the jurisdiction of the competent court in [city].
